Terms and Conditions PART I: INTRODUCTION AND LEGAL FRAMEWORK IDEAL TRAVEL ASIA BRANCH OF NAM CUONG JOINT STOCK COMPANY (IDEAL TRAVEL ASIA), website https://idealtravelasia.com/, was established under the business license with Business Code 0101630512-008, issued by the Department of Planning and Investment of Hanoi City on January 20, 2017 (hereinafter referred to as “IDEAL TRAVEL ASIA”) The customer must ensure that after confirming the service booking, the customer has accepted the service conditions, payment terms, and payment amount for the service he or she has ordered. These terms and conditions apply to all transaction activities between you and IDEAL TRAVEL ASIA BRANCH OF NAM CUONG JOINT STOCK COMPANY (IDEAL TRAVEL ASIA), and through the operating booth on the website https://idealtravelasia.com/. You agree to be bound by these Terms, which are drafted in accordance with the applicable laws of Vietnam and are free from any requirements. PART II: CORE PROVISIONS Article 1: Price Policy & Cost Adjustments 1.1. Quotation: All tour prices are fundamentally calculated and quoted in Australian Dollar (AUD), based on tariffs, fuel costs, and taxes effective at the time of quotation. 1.2. Price Protection Clause: Ideal Travel Asia reserves the right to adjust the tour price at any time up to 14 days before departure if there are significant increases in input costs beyond our control, including: Fuel Surcharges: Sudden spikes in global oil prices impacting transportation. Government Levies: New or increased VAT, entrance fees at heritage sites, or environmental taxes. Exchange Rates: Fluctuations exceeding 3% in the VND/USD exchange rate. 1.3. Client Option: If the price increase exceeds 10% of the total contract value, the Client may cancel the tour and receive a refund, minus non-refundable fees already paid to third-party suppliers (Airlines, Cruises,...). Article 2: Payment Terms 2.1. Deposit: A non-refundable deposit (30%) is required to secure the booking. 2.2. Final Payment: Full payment must be settled at least 30 days before departure (unless otherwise agreed for urgent bookings). Failure to pay on time may result in automatic cancellation of the booking and lost of deposit. Article 3: Cancellation & Refund Policy 3.1. Cancellation by Client: Penalties are applied based on the time of written notification: 30+ days before departure: 30% of total contract value. 15 - 29 days before departure: 50% of total contract value. 07 - 14 days before departure: 70% of total contract value. Within 7 days or No-show: 100% of total contract value. 3.2. Refund Process: Approved refunds will be processed within 30 days via the original payment method. Any bank transfer fees shall be borne by the Client. Article 4: Flight & Train Tickets Once tickets are issued, they are subject to the specific terms of the carrier (Vietjet, Vietnam Airlines, etc.). Any changes in name, date, or cancellation will incur fees as per the carrier’s policy plus an Ideal Travel Asia administrative fee. Article 5: Force Majeure 5.1. Ideal Travel Asia shall not be liable for any failure to perform its obligations if such failure is the result of Force Majeure, including: fire, extreme weather, natural disasters, war, pandemics (e.g., COVID-19), border closures, or strikes. 5.2. In such events, Ideal Travel Asia will act as a mediator to recover costs from suppliers but is not obligated to provide a cash refund if the supplier refuses. We reserve the right to retain a reasonable Administrative Fee for services already rendered. Article 6: Alteration of Itinerary Ideal Travel Asia reserves the right to rearrange the sequence of attractions, change accommodation, or alter transportation for the safety and benefit of the group. The Client will be notified of major changes as soon as possible. Article 7: Client Responsibilities 7.1. Documentation: Provide valid passports (at least 6 months validity), visas, and health certifications. 7.2. Illegal Stay: Any Client who separates from the group to stay illegally in a foreign country will face full legal prosecution and must compensate Ideal Travel Asia for any brand damage and fines imposed by authorities. 7.3. Conduct: Clients must follow the Tour Guide’s instructions and local laws. Any costs arising from misconduct or self-separation from the group are the Client's responsibility. Article 9: Health & Safety The Client must ensure they are fit for travel. Any pre-existing medical conditions must be disclosed. Ideal Travel Asia is not responsible for any health-related incidents during the trip. Article 10: Travel Insurance It is a mandatory condition of booking that the Client possesses comprehensive travel insurance covering medical emergencies, trip cancellation, and repatriation. Article 11: Media Consent The Client agrees that Ideal Travel Asia may use photos or videos taken during the tour for marketing and promotional purposes on https://idealtravelasia.com/ and social media without further compensation. Article 12: Seller’s Obligations Ideal Travel Asia commits to providing accurate information, ensuring service quality as contracted, and fulfilling all tax and e-commerce legal obligations under Vietnamese law. PART III: CONCLUSION & DISPUTE RESOLUTION Severability: If any provision of this Agreement is found to be invalid by a court, the remaining provisions shall continue in full force and effect. Dispute Resolution: Any dispute arising out of or in connection with this contract shall first be settled through friendly negotiation. If negotiation fails within 30 days, the dispute shall be referred to: Arbitration: The Vietnam International Arbitration Center (VIAC) at the Vietnam Chamber of Commerce and Industry (VCCI). Litigation: The competent People's Court in Hanoi, Vietnam. Governing Law: This Agreement is governed by the laws of the Socialist Republic of Vietnam.
